Terms & Conditions for Donations to the St Mary's School Waverley Foundation
1. DEFINITIONS & PARTIES
1.1 "Foundation" means St Mary's School Waverley Foundation, a non-profit organisation
registered in the Republic of South Africa, with registration number: 2007/005844/08.
1.2 "Donor" means any individual or legal entity making a voluntary donation to the Foundation.
1.3 These terms and conditions govern all donations made to the Foundation, whether once-off or
recurring, by EFT, card payment, debit order, or any other accepted method.
2. PURPOSE OF DONATION / USE OF FUNDS
2.1 Donations support the Foundation's objectives, which include supporting St. Mary's School,
Waverley through fundraising, awarding bursaries, and building a substantial permanent
endowment to sustain excellence in academics, culture, and sport.
2.2 Unless the Donor specifies a designated purpose in writing and the Foundation accepts it,
donations may be applied at the Foundation's discretion.
2.3 Donations are voluntary and gratuitous. The Donor receives no material consideration,
benefit, or advantage in exchange.
3. IRREVOCABILITY AND REFUNDS
Once a donation has cleared into the Foundation's bank account, it becomes the exclusive
property of the Foundation and is non-refundable.
4. PAYMENT METHODS AND PROCESSING
4.1 Accepted payment methods include EFT, credit/debit card payments via secure gateway, debit
order, and any additional mechanisms approved by the Foundation.
4.2 A formal receipt will be issued within a reasonable period after confirmed payment.
4.3 Card transactions are processed through third-party service providers. The Foundation does
not store full card information.
5. TAX COMPLIANCE AND CERTIFICATES
5.1 The Foundation is a registered Public Benefit Organisation (PBO) eligible to issue Section
18A tax-deductible certificates, where applicable.
5.2 Donors may request a Section 18A certificate for qualifying donations.
5.3 Donors are responsible for ensuring compliance with their own tax obligations.
6. DONOR PRIVACY AND DATA PROTECTION
6.1 Personal information provided by Donors will be used solely for processing donations,
issuing receipts, statutory compliance, and administrative purposes.
6.2 Personal information is handled in accordance with the Protection of Personal Information
Act, 2013 and such other applicable privacy and data-protection legislation, as amended from
time to time.
6.3 Personal information will not be shared with third parties except where required by law or
payment-processing obligations.
7. RECOGNITION AND PUBLICITY
7.1 With the Donor's consent, the Foundation may publicly acknowledge donations (e.g., donor
lists, school publications, reports, events).
7.2 Donors who wish to remain anonymous may request confidentiality, which the Foundation will
honour except where disclosure is mandated by law.
8. RIGHT TO REFUSE DONATIONS
8.1 The Foundation may refuse or return a donation if:
a. the funds originate from illegal, unethical, or unclear sources;
b. acceptance compromises the Foundation's reputation or independence;
c. donor-imposed conditions conflict with the Foundation's values, governance, or operations;
d. the Donor fails to provide required compliance documentation;
e. the Donor or entity is subject to sanctions or legal restrictions.
9. AMENDMENT OF TERMS
9.1 The Foundation may amend or update these terms and conditions from time to time.
9.2 Amended terms apply to all donations received after the effective date of publication.
10. GOVERNING LAW AND JURISDICTION
10.1 These terms and conditions are governed by the laws of the Republic of South Africa.
10.2 Any disputes arising from donations shall fall under the jurisdiction of the North Gauteng High Court (or such other appropriate South African court).
